Agreement to Terms: By accessing or using The JERK Tracker X mobile application or web service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Paintbrush Marketing ("Company," "we," "us," or "our") regarding your use of The JERK Tracker X application and related services (collectively, the "Service").

1.1 Who Can Use Our Service

You must be at least 13 years old to use this Service
If you're under 18, you must have parental or guardian consent
You must be authorized to represent your restaurant or business
You must provide accurate and complete registration information
You must comply with all applicable local, state, and federal laws

1.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email notification or in-app notification. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Service Description

The JERK Tracker X provides restaurant order tracking and management services including order management, QR code generation, driver check-in, real-time tracking, dashboard analytics, multi-user role-based access, and mobile & web access.

2.1 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service
Scheduled maintenance will be announced in advance when possible
Service may be temporarily unavailable due to circumstances beyond our control

3. User Accounts

3.1 Account Registration

To use The JERK Tracker X, you must create an account by providing a valid email address, a secure password, your restaurant or business name, and contact information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, notifying us immediately of any unauthorized use, and not sharing your account with others.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activities, your account has been inactive for more than 12 months, or we receive a valid legal request.

4. Acceptable Use Policy

4.1 Permitted Use

You may use The JERK Tracker X only for managing restaurant order tracking and pickup coordination, business purposes related to food service operations, and lawful activities in compliance with all applicable laws.

4.2 Prohibited Activities

You agree NOT to:

Use the Service for any illegal or unauthorized purpose
Transmit viruses, malware, or harmful code
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Use automated scripts or bots to access the Service
Collect or harvest user data without permission
Impersonate another person or entity
Reverse engineer, decompile, or disassemble the app
Resell or redistribute the Service without authorization

⚠️ Violation Consequences: Violation of the Acceptable Use Policy may result in immediate account suspension or termination without refund, and we may report illegal activities to law enforcement.

5. Intellectual Property Rights

The JERK Tracker X and all its contents, features, and functionality are owned by Paintbrush Marketing and are protected by copyright, trademark, and other intellectual property laws. You retain all rights to the data you input into the Service. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your business purposes.

6. User Content & Data

You are responsible for all data and content you submit. By submitting User Content, you grant us a limited license to store and process your data to provide the Service, display it to authorized users in your account, and use anonymized, aggregated data for analytics and improvements. We will never sell your data or share it with third parties for marketing purposes.

7. Payment Terms

7.1 Pricing

Current pricing is available at paintbrushmarketing.net/jerktracker. Prices are subject to change with 30 days notice. All prices are in USD.

7.2 Billing & Refunds

Subscriptions automatically renew unless cancelled
Cancel anytime; service continues until end of billing period
Payments are non-refundable except as required by law
Pro-rata refunds available at our discretion for service issues

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAINTBRUSH MARKETING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms are governed by the laws of Jamaica and the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits.
